Property formation and specialist property law

Property formation is a process whereby new properties are created by dividing or merging existing properties. It can involve dividing an existing property into several smaller parts or merging several properties into one larger one. Property formation is often an important component of large and small property development projects, as part of asset and business sales, or sometimes as a way to cost-effectively complete a property transaction.

Everything related to this is usually put in the category of ‘specialist property law’. This includes rules relating to property boundaries, ownership, easements, common facilities, rights of use and other rights and obligations that may be attached to a property. It is a complex and broad area that has a major impact on people’s everyday lives and the ability of a town or city to function properly.

A common element of specialist property law is a land survey, which often begins with an application that we at NORMA submit on behalf of a property owner or other party who wants to make changes to one or more properties owned or to be purchased. The Land Surveyor’s Office then investigates the matter and makes a decision on the application. It then investigates the matter and carries out any boundary markings and surveys to establish the exact locations and boundaries of the properties. New properties can then be created and become separate entities with their own property designations. The rights and obligations of the property owner are determined in connection with the land survey and registered in the land register.
