There are several different types of leasholds – building leases, residential leases, agricultural leases, apartment leases and fishing leases. Both as a lessor (landowner) and as a lessee/user, there are several rules that are important to know in order to get the most out of a leasehold relationship.

At NORMA, we primarily represent lessors/landowners in a number of different leasehold issues. In many cases, there are mandatory rules that apply, regardless of what the parties have agreed. These are particularly important for a lessor to be aware of.

The rules on site leases are very similar to those for renting premises, and the rules on residential leases are very similar to those for residential tenancy. Above all, it is the rules on security of tenure and the formal requirements for termination that can have major consequences if a lessor does not really know what the legislation looks like.
