Other commercial administrative law
With commercial administrative law, we have tried to bring together the many issues that a business may encounter in its activities and that are in some way concerned with or affected by public policy. There are approximately 500 types of cases in the administrative courts and it is therefore not easy to summarise in a general way all the situations that businesses may encounter. In many cases, a company is dependent on the public sector’s assessments and decisions, etc. This can arise, for example, through various licence issues, recovery, penalties and other sanctions, but also aid and subsidy issues, regulatory issues or other types of follow-up and negotiations with the public sector.
Commercial administrative law can be sector-specific, but there are also more general laws and regulations aimed at companies that can affect a company’s operations in various ways. The public sector consists of, among others, regions, municipalities, authorities and municipal companies. Among the authorities that are commonly involved in commercial administrative law are the following: the Swedish Competition Authority, the Swedish Transport Agency, the Swedish Work Environment Authority, Swedac, the Swedish Chemicals Agency, the Swedish Medical Products Agency, the Swedish Food Agency, the Swedish Agency for Economic and Regional Growth and the county administrative boards.
When a company is faced with situations that are affected or controlled by the public sector, the process is in many cases similar, although in many respects it can be complex and many aspects to take into account.
