Procurement

In principle, all purchases made by public authorities are subject to public procurement rules. There are various procurement rules, such as the Public Procurement Act (“LOU”), the Act on Procurement in the Utilities Sectors (“LUF”) and the Act on Procurement of Concessions (“LUK”). What these provisions have in common is that they are central and play a major role in the Swedish economy, as the total value of all procurements amounts to approximately SEK 800 billion each year.

Despite the fact that procured contracts are common, and play a major role in society, many people perceive the rules as complicated and complex. It is not possible to say that those who perceive the rules in this way are wrong, as procurement can often be complex and difficult to understand; several circumstances need to be taken into account and extensive demands are often placed on both the contracting organisation and the supplier.

NORMA has been advising both contracting organisations and suppliers for a long time. We have extensive experience in providing clear and practical advice at all stages of a procurement, whatever the subject matter. This means we can help you, with your question, whenever you want or need it:

  • initiate dialogue with a contracting organisation before a procurement;
  • support in reviewing and analysing advertised procurement documents
  • ask questions and liaise with the contracting organisation during the procurement process
  • support in preparing tenders and conducting negotiations with the contracting organisation
  • analysing award decisions and evaluation reports, etc;
  • counselling in case of review of procurement or contract validity
  • advising on contract follow-up, negotiations and court proceedings regarding breach of contract and damages, etc.

For large procurements and complex projects, NORMA forms a well-adapted team of staff who have knowledge in the legal areas needed outside the procurement rules, please read more about NORMA’s offer in Corporate commercial and commercial disputes.
